Alan G. Fishel
In addition, Alan is a member of the Cybersecurity & Data Protection group, the Corporate group, and the Government Relations/Political Law group at the firm. Alan practices in front of the FCC, and is nationally recognized for his advocacy and transactional skills. Alan’s clients’ success rate in FCC proceedings and other advocacy matters is extremely high, and Alan also handles an array of transactional matters relating to technology and telecommunications-related agreements. He also frequently provides seminars, workshops, and webinars to in-house counsel (including for both the American Association of Corporate Counsel and a local chapter of the American Association of Corporate Counsel), regarding how to most effectively draft and negotiate a wide variety of agreements, including technology agreements. Alan also received an award for his contributions to the work that led to his client receiving the only national infrastructure grant given under the BTOP program, which was for more than $62 million.
Alan’s clients include both customers and providers of technology services, telecommunications services, and wireless services, operators of research and education networks, educational institutions, providers of emerging technologies, colocation providers, foundations, non-profit associations, and equipment manufacturers. Alan also represents professional sports teams, commercial office building owners, hotel owners, and other entities in connection with their receipt of in-building wireless services and in conjunction with rooftop antenna leases.
Alan drafts and negotiates a wide variety of agreements involving, among other things, cloud computing services, software licenses, telecommunications, cable and IP-based services, eTexts, in-building wireless services, Wi-Fi services, antennal licensing, wireless towers, and the provision of dark fiber. Alan represents clients before the FCC on matters concerning universal service, e-rate, pole attachments, public rights-of-way (including Section 253 issues), public safety, digital television, voice over IP, the Telephone Consumer Protection Act, wireless and data services, cable services, cable programming, cable encryption, equipment authorization requirements, unlicensed devices, ultra-wide band, regulatory fees, and emerging technologies. Alan also represents clients in front of Congress, NTIA, DOE, DOJ and the FTC.
Publications, Presentations & Recognitions
Alan was recognized as a leading telecommunications lawyer by Legal 500 for 2011, 2012, 2013, 2014, and 2015. In light of Alan’s work, the Association of Corporate Counsel chose Arent Fox to be its exclusive law firm content provider for ACC’s negotiation portal, and Alan is the lead attorney in connection with providing the substance for that portal. In addition, Alan provides numerous presentations each year to in-house counsel in connection with drafting and negotiating a wide variety of agreements, including technology agreements. Alan is also the author of many legal articles and publications.
Alan was recognized by a client with an award for his contributions to the work that led to the client receiving the only national infrastructure grant given under the BTOP program. In addition, Alan was recognized by the Washington Lawyers’ Committee when he received the Vincent E. Reed award for his unique and long-standing contributions to public education.
Life Beyond the Law
Alan created an award-winning geography game, GeoPlunge, which has been played by thousands of children in the DC school system over the past 12 years. Twice a year, hundreds of children play in GeoPlunge tournaments at the Smithsonian National Portrait Gallery, which events are run by Arent Fox, the DC public school system, and the Washington Lawyers’ Committee. Numerous businesses coach teams in connection with these tournaments. The Chancellor of the DC public school system has stated that the GeoPlunge tournaments are “incredible to see” and GeoPlunge “has a catalytic effect” on our students while providing an “opportunity [that] is huge for our students.” Alan is also in charge of the firm’s business partnerships with an elementary school and a high school and supervises the firm’s attorneys and staff that work on matters performed for the schools.
